We will obtain a copy of the title register for the property from the Land Registry so that we can let the buyers solicitors have a copy as evidence that you legally own the property.
We then prepare the contract setting out the agreed terms of the sale. You will also be asked to complete standard property information forms and we will assist you with these. The buyer’s solicitors may raise additional enquiries, which we will help you respond to.
Once both parties are ready, a completion date is agreed and contracts are formally exchanged. At that point, the transaction becomes legally binding.
On completion, we receive the purchase funds from the buyer’s solicitors. We redeem any existing mortgage, settle agreed costs (such as estate agents’ fees and our fees) and transfer the remaining balance to you. If you are moving home, we apply it towards your related purchase.
When we receive the draft contract pack from the seller’s solicitors, we review the contract, title documents and property information forms in detail. We also carry out the necessary searches and raise enquiries to clarify any issues or concerns.
If you are obtaining a mortgage, we carefully review the mortgage offer and ensure that any lender conditions are satisfied.
Before the exchange of contracts, we provide you with a full written report explaining the legal position and pointing out any important matters. Once you are happy to proceed, you will sign the contract and transfer the deposit.
Contracts are then exchanged and a completion date fixed. On completion, we transfer the purchase funds to the seller’s solicitors, arrange payment of any Stamp Duty Land Tax due and register your ownership at HM Land Registry.
There is a principle in conveyancing of buyer beware, which imposes a duty on the buyer to investigate the physical condition of the property before the exchange of contracts. Once contracts are exchanged, you accept the property in its current state.
While we deal with the legal aspects of the transaction, we do not assess the structural condition of the property.
If you are obtaining a mortgage, your lender will usually carry out a basic valuation for lending purposes. This is not a detailed survey. In most cases, we recommend instructing an independent surveyor to carry out a HomeBuyer Report or for older or higher-value properties, a full structural survey.
An Energy Performance Certificate (EPC) is a legal requirement when a property is built, sold or rented. It provides an energy efficiency rating from A (most efficient) to G (least efficient), together with recommendations for improvement.
The seller is responsible for obtaining a valid EPC before marketing the property.
