Make a Will – it really is that simple. By making a Will, you decide who inherits your estate when you die. Without one, your estate will be distributed according to the rules of intestacy.
Contrary to popular belief, being married or living with a long-term partner does not guarantee that they will inherit everything.
The intestacy rules follow a strict order:
If there are children, the spouse/civil partner receives the first £322,000 (the statutory legacy), plus half of the remainder of the estate, and all personal belongings.
The children receive the other half of the remaining estate, shared equally.
If there is no spouse/civil partner or children, the estate passes to relatives in a fixed order. Unmarried partners, co-habitees, and step-children are not included.
